Court dismisses suit challenging Obama

The Indiana Court of Appeals on Thursday affirmed a Marion County judge’s dismissal of a lawsuit by two Hoosiers challenging President Barack Obama’s eligibility to hold office.

The case disputed Hawaii-born Obama’s status as a “natural-born citizen.” Steve Ankeny, New Castle, and Bill Kruse, Roselawn, represented themselves in the suit, which Judge David Dreyer dismissed in March.

Their suit said Indiana’s 11 Democratic electors weren’t properly chosen because Gov. Mitch Daniels didn’t first verify the eligibility of Obama or Sen. John McCain, his Republican opponent, in the 2008 election. They argued Obama was not eligible for the presidency because his father was not a U.S. citizen.
